A homeowner's dream of building a beautiful detached executive dwelling house in Stoke-on-Trent faced initial setbacks. Despite multiple refusals, the homeowner sought our expert guidance to navigate the planning process.

An appeal was made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant planning permission for a new house. The refusal was based on the character and appearance of the surrounding area in terms of “poor” design and the detrimental and negative impact on the living conditions of neighbouring occupiers.
We get asked to submit planning appeals and unlike our “competitors”, we like to be honest and upfront; if we don’t think you will win the planning or enforcement appeal, we will tell you. In this case, we advised the client that he should appeal.

What we learnt was that sometimes officers will refuse schemes if they are not represented by professional and qualified Town Planner - without getting challenged council planning officers may refuse schemes where they are “borderline”. Sometimes people may try and save money by using other cheap firms who rely on exaggerated reviews on the internet; we are not the cheapest and we are not on Tiktok!
